House Adopts Mackenzie Measure to Exempt All 529 Plans from Inheritance Taxes
HARRISBURG – The Pennsylvania House unanimously adopted an amendment from Rep. Ryan Mackenzie (R-Berks/Lehigh) on Wednesday that would exempt transfers to all qualified 529 college savings accounts from inheritance taxes.

Current law only exempts Pennsylvania-based 529 plans. The Mackenzie amendment would extend the exemption to other state’s 529 programs and other eligible plans maintained by educational institutions.

“Presently if a family member establishes a 529 college savings account in another state and dies, contributions to that account could be subject to inheritance taxes,” said Mackenzie. “The amendment I introduced would protect the full value of investments made toward higher education.”

The Mackenzie measure was amended onto House Bill 2202, legislation designed to protect college saving accounts from creditors. The amendment would achieve the same end as legislation introduced by Mackenzie earlier this year, House Bill 1208.

Mackenzie added, “This amendment affirms our continued commitment to education and would increase opportunities for families to save for future education costs.”

The amended bill must now be considered by the full House before it can go to the Senate for further consideration.
